Terms & Conditions

These Terms & Conditions ("Terms") apply to your use of the EKART website and services, operated by ZIAGO TECHNOLOGIES PVT LTD ("we", "us"). By using the website or placing an order you agree to these Terms. If you do not agree, please do not use the website.

1. The marketplace

EKART is an online marketplace. Products are listed and sold by independent sellers registered with us. The contract of sale for a product is between you and the seller; we provide the platform, collect payments on the seller's behalf, arrange delivery and handle customer support, returns and refunds.

2. Your account

• You must be at least 18 years old, or use the website under the supervision of a parent or guardian.
• Keep your password safe. You are responsible for activity on your account; tell us at once if you suspect misuse.
• The information you give us (name, mobile number, email, addresses) must be accurate and kept up to date.
• We may suspend or close an account used for fraud, abuse, or in breach of these Terms.

3. Products, prices and availability

• Product descriptions, pictures and prices are provided by the sellers. We ask sellers to describe products accurately, but colours may look slightly different on your screen.
• Prices are in Indian Rupees and include applicable taxes unless stated otherwise. Delivery charges, if any, are shown at checkout before you pay.
• A product is only reserved for you once your order is placed. If a product turns out to be unavailable or wrongly priced, we or the seller may cancel the order; any amount you paid is refunded in full.

4. Orders and payment

• Placing an order is an offer to buy. The order is confirmed when the seller accepts it.
• You can pay online (UPI, cards, net banking, wallets) through our payment gateway partner, or by cash on delivery where the seller offers it. Some products are available for online payment only.
• For online payments we do not store your card details; they are handled by the payment gateway.
• We may refuse or cancel an order that appears fraudulent, or where the delivery address cannot be served.

5. Delivery

Delivery is covered by our Shipping & Delivery Policy. Risk in a product passes to you on delivery.

6. Cancellations, returns and refunds

These are covered by our Cancellation & Refund Policy and Returns Policy, which form part of these Terms.

7. Using the website

You agree not to:

• use the website for anything unlawful, or to buy products for resale in breach of the seller's terms;
• copy, scrape or reproduce content from the website without our written permission;
• interfere with the website's security, or upload viruses or harmful code;
• post false reviews or misleading information.

8. Intellectual property

The EKART name, logo and website design belong to ZIAGO TECHNOLOGIES PVT LTD. Product names, pictures and descriptions belong to the sellers or their licensors. Nothing on the website gives you a right to use them.

9. Liability

We work hard to keep the website accurate and available, but it is provided "as is". To the extent permitted by law, we are not liable for indirect or consequential losses. Our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.

10. Changes to these Terms

We may update these Terms from time to time. The version on this page is the one that applies; the date of the latest change is shown below the title.

11. Law and disputes

These Terms are governed by the laws of India. Please contact us first (see Contact Us) so we can try to resolve any problem. Courts at the place of our registered office have jurisdiction, without affecting your right to approach a consumer commission.
